Terms of Use

Last updated: October 27, 2026

These terms are an agreement between you and Nicole Testa, trading as DanceMark ("we", "us") for your use of the DanceMark app. By creating an account or using DanceMark you agree to them. If you don't agree, please don't use the app. Contact: DanceMarkApp@outlook.com.

1. Your account

You must be at least 13 years old (or the minimum age required where you live) to use DanceMark. Keep your password private. You're responsible for activity on your account. You can delete your account at any time in Profile → Delete Account.

2. Your content

You own the classes, lesson plans, notes, photos, and posts you create. You give us permission to store, display, and transmit that content only as needed to run DanceMark, for example showing a shared plan to the teacher you shared it with, or showing your Community posts to other teachers.

Only post content you made yourself or have permission to share. That includes photos, videos, and links to videos or articles on other websites. DanceMark doesn't control other websites and isn't responsible for what's on them.

Choreography. Choreography can be protected by copyright. Share your own choreography, or choreography you have permission to share, and credit the choreographer when you can. Posts in Community and Explore are there for ideas and inspiration: don't copy and teach someone else's whole routine without their permission. Single steps, short combinations, and well-known dances aren't owned by anyone, so teach those freely. You're responsible for what you teach and share.

Copyright complaints

If you believe something on DanceMark infringes your copyright, email DanceMarkApp@outlook.com with: a link to the content, a description of the work you own, your name and contact details, a statement that you believe in good faith the use isn't authorised, and a statement that the information is accurate and that you own the rights or are authorised to act for the owner. We remove infringing content promptly, and we close the accounts of people who repeatedly post content they don't have the right to share.

3. Community rules: zero tolerance for objectionable content

Community is a place for teachers to help each other. We have zero tolerance for objectionable content or abusive users. You agree not to post content that:

Every post and answer can be reported, and you can block any user. We review reports promptly, normally within 24 hours, and remove content that breaks these rules. Users who post objectionable content may be suspended or permanently removed without notice.

4. Studios and sharing

Studio owners and admins control their studio's classes, members, and curriculum. Content you create for a studio class belongs to that studio's records. If you leave a studio, are removed from it, or the studio closes, you and the studio each keep a copy of the classes you taught there, with their skills, lesson plans and your notes. Only share plans and assign substitutes with people you trust; you can revoke a share at any time.

5. DanceMark Pro and studio plans

6. Acceptable use

Don't misuse DanceMark: no attempting to access other people's accounts or data, interfering with the service, scraping, or using the app for anything unlawful.

7. Ending your use

You can stop using DanceMark and delete your account at any time. We may suspend or end your access if you break these terms, especially the Community rules.

8. Disclaimers and limitation of liability

DanceMark is provided "as is". We work to keep it reliable and your data safe, but we can't guarantee it will always be available or error-free; keep your own copies of anything critical. Teaching decisions, including student safety and the suitability of any skill or exercise, remain your professional responsibility. To the extent the law allows, we are not liable for indirect or consequential losses, and our total liability is limited to the amount you paid us in the 12 months before the claim. Nothing in these terms limits or excludes liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot be limited or excluded by law, and nothing affects your statutory rights as a consumer.

9. Apple

These terms are between you and us, not Apple. Apple is not responsible for DanceMark or its content, has no obligation to provide maintenance or support, and is a third-party beneficiary of these terms with the right to enforce them against you. Apple's Standard Licensed Application End User License Agreement also applies to your use of the app, except where these terms say otherwise.

10. Changes and governing law

We may update these terms; if we make significant changes we'll let you know in the app, and continuing to use DanceMark means you accept them. These terms are governed by the laws of the State of Florida, United States, and disputes will be handled by the state or federal courts in Florida. If you live elsewhere, you keep any protections your local consumer law gives you.
